Do You Need to be Vaccinated to Attend Property Inspections?

We have received many questions about whether people attending property inspections need to be fully vaccinated for COVID-19. There is no WA Government mandate that places any restrictions on people being fully vaccinated prior to entering a private home.

Any requests to restrict entry are a personal choice by the owner and/or tenant. Agents currently restrict entry for reasons not related to COVID-19, for example a person who is not prepared to identify themselves.

There are several scenarios where requests to restrict entry may come about:

  • An owner requests that only fully vaccinated people and those who are not infectious with a COVID-19 variant shall be permitted entry,
  • A tenant requests that only fully vaccinated people and those who are not infectious with a COVID-19 variant be permitted entry,
  • An agency wants to implement a policy that only fully vaccinated people and those who are not infectious with a COVID-19 variant be permitted entry.

The underlying question is whether restricting entry to people who are fully vaccinated and who are not infectious with a COVID-19 variant is unlawful discrimination. Restricting entry to a home is unlikely to be discriminatory, however it will depend upon the circumstances.
